Host Terms and Conditions 

 Agreement between Partner & HolidayFox Ltd 

Introduction  

The Terms and Conditions outlined herein by Holidayfox.com are subject to changes, which will take immediate effect upon modification. Utilizing the HolidayFox platform implies adherence to the most recent version of the Terms and Conditions available on the platform. The Terms and Conditions encompass the services facilitated by HolidayFox, whether directly or indirectly. These services are detailed in the “Definitions” segment that follows. Partners must read, comprehend, and consent to the Terms and Conditions and Privacy Policy. 

By using HolidayFox, you guarantee that all provided information is accurate and lawful. 

HolidayFox Ltd, bearing company number 12470762, is registered in England & Wales with its registered address at International House, 64 Nile Street, London, N1 7SR. 

Definitions 

  • HolidayFox: Refers to HolidayFox Ltd, a UK-based company located at International House, 64 Nile Street, London, N1 7SR, United Kingdom. 

  • Host/Campsite/Partner: Denotes any owner or representative of accommodation or activities that agree to list their services on the HolidayFox platform. 

  • Platform: The digital medium (website or app) managed by HolidayFox where services are available. 

  • Commission: The fee rate determined by the service package chosen by the partner. 

  • Payment Processing via Stripe Connect: HolidayFox integrates with Stripe Connect, enabling hosts to process financial transactions for bookings made on the HolidayFox platform through their individual Stripe accounts. Payments from bookings are routed directly to the host's Stripe account after the automatic deduction of HolidayFox's commission and other associated fees. The host is solely responsible for ensuring their Stripe account is in good standing, is verified, and remains compliant with Stripe's terms of service. The host is also tasked with managing and resolving any disputes, chargebacks, or issues related to payment processing through Stripe. 

  • Cancellation Policy & Refunds: The host is mandated to set, communicate, and enforce their own cancellation policy. All responsibilities concerning cancellations, refunds, and associated procedures lie with the host. It is imperative that hosts provide transparency regarding their cancellation policy to ensure guests are well-informed. 

  • HolidayFox Fees: Hosts will incur a commission of 5% of the booking fee + VAT for leveraging the HolidayFox platform. Additionally, a monthly flat fee of £9.99 will be charged for the widget & booking system, or £12.99 for website and booking system. These charges do not include Stripe payment processing fees, which are billed directly by Stripe and deducted from the host's Stripe account. Such fees are separate from, and in addition to, the fees levied by HolidayFox. These fees are non-refundable in the case of a cancellation or refund.

Services 

The HolidayFox platform offers an array of digital tools and features for hosts. This includes access to the HolidayFox website, partners' admin login system, the HolidayFox booking widget, custom website interface across various devices, the utilization of API’s, and other functionalities integral to optimizing the host experience. 

Partnership Agreement and Responsibilities 

By listing on HolidayFox.com, partners assume all responsibilities related to booking confirmations. Upon confirming a booking, partners adhere to the set prices, services, and terms. Monetary transactions executed between HolidayFox.com and partners will undergo deductions such as the aforementioned fees or commissions. The responsibility of managing Stripe transaction fees, as well as any other Stripe-related financial matters, is borne solely by the partner. 

HolidayFox.com provides tools for managing your listing. While you are responsible for the accuracy of information provided, our team is available to support any adjustments. We highly suggest reviewing your Terms and Policies, especially in areas of potential disputes. Decisions regarding pricing, terms, and listing regulations rest solely with the partner. 

Legal Compliance 

Partners are responsible for adhering to any applicable laws and regulations concerning their listings. This includes necessary permits and ensuring compliance with GDPR and other privacy laws.  

Indemnification  

By agreeing to these terms, partners commit to safeguarding HolidayFox.com and its stakeholders from any third-party claims resulting from a breach of this agreement, violation of any law or right, or use of this platform.  

Fees and Payment Processing  

Hosts will incur a commission of 5% of the booking fee + VAT for using the HolidayFox platform. Additionally, there's a monthly flat fee of £9.99 for widget & booking system or £12.99 for website and booking system. It's crucial to note that these fees are exclusive of the Stripe payment processing charges. Payments for bookings made on the HolidayFox platform are processed directly through the host's Stripe account. Once the necessary deductions for HolidayFox's commission and other associated fees are made, the remaining amount is routed to the host's Stripe account. All fees related to Stripe payment processing are directly billed by Stripe and are separate from the fees charged by HolidayFox.  Please note these fees are non refundable in the case of a refund or cancellation.

 Cancellations

Cancellations and refunds are processed as per the providers cancellation policy. Please note that cancellations or refunds are exclusive of the HolidayFox booking or Stripe fees.

Intellectual Property Rights 

HolidayFox Ltd retains the intellectual property rights for content and infrastructure on the platform. Unauthorized modification, distribution, or reproduction of platform content is prohibited.  

User-Generated Content: Reviews, Photos, and Interactions 

Once a campsite is claimed on HolidayFox.com, we reserve the right to utilize the related photos, text, and videos. By submitting content, you grant HolidayFox.com extensive rights over its usage, distribution, and modification. 

Content Notification and Removal Policy  

Holidayfox.com operates on a notice and removal basis. If there are concerns regarding the content, partners should contact support@holidayfox.com. Breach of terms may lead to content removal or partnership termination. 

Termination Provisions 

Either party can terminate the agreement with a months written notice. Post-termination, providers must still honor any pending bookings. 

Enforceability, Legislation and Jurisdiction 

Should any terms be deemed unenforceable, the remaining terms remain unaffected. Delays in addressing breaches do not equate to waivers. If HolidayFox waives a specific breach, it doesn’t apply to future breaches. 

Amendments for Stripe Connect Integration 

Considering the move to Stripe Connect: 

  • Providers are obligated to link their individual Stripe accounts for transaction processing on the HolidayFox platform. 

  • Payments related to bookings are processed directly through the provider's Stripe account, with the pre-agreed commission subtracted before the provider receives the funds. 

  • All disputes, chargebacks, or issues emanating from Stripe transactions are the responsibility of the provider. 

Dispute Resolution 

In the event of a dispute between a partner and HolidayFox, both parties commit to an initial period of thirty (30) days to resolve the matter amicably through direct communication. If the dispute persists beyond this period, either party may propose mediation with a mutually agreed-upon mediator. If mediation doesn't lead to a resolution, the dispute will be settled under the exclusive jurisdiction of the courts of England & Wales.
